Privacy Collection Notice

This Privacy Collection Notice relates to the One Foot Forward Campaign and Mobile App.

Black Dog Institute (ACN 115 954 197) (we, our, us, Black Dog Institute) is a Medical Research Institute and a global leader in translational mental health research. We harness the latest technology and other tools to quickly turn our world-class research findings into clinical services, education and e-health products that improve the lives of people with mental illness and the wider community.

During October, we are running the One Foot Forward campaign (Campaign), which is a free virtual walking event that individuals can take part in to raise funds for crucial mental health research and support services at Black Dog Institute.

As part of this Campaign, you can record and track your fundraising and progress towards your fitness goals on our website: https://www.onefootforward.org.au/. You can also use our One Foot Forward App (App) to assist you to track and log the kilometres you have walked and track your fundraising progress throughout the Campaign.

If you register or are invited to register for the Campaign (either because you sign-up directly or you are invited to register for the Campaign by a friend, family member or colleague), we may collect certain personal information from you or your friend, family member or colleague via our website or through our App. We understand the importance of being open and transparent with you in the way in which we collect, store, use and share your personal information. We take protecting your privacy rights very seriously and our website and App have been designed, where possible, to give you control over what personal information you share.

We strongly encourage you to read this notice before you register for the Campaign or download and use the App, so that you understand and are comfortable with how we handle your personal information. If you are registered to participate in the Campaign, you will also be subject to our Campaign Terms which you can access via our website and App.

Who does this Privacy Collection Notice apply to?

This Privacy Collection Notice applies if you are invited or registered to participate in the Campaign. Any reference to you or your is a reference to someone who has, or has been, invited to or registered and signed up to the Campaign.

You must be over 15 years of age to provide Black Dog Institute with personal information. If you are under 15 years of age, your parent or other ‘responsible person’ will need to provide your personal information to us on your behalf. If you are providing personal information to us as a ‘responsible person’, you must take reasonable steps to explain this privacy collection notice to the individual that you are providing information on behalf of in age appropriate terms.

Under the Campaign Terms, you must be at least 18 years old to participate in the Campaign unless you have obtained parental consent to participate in the Campaign by way of submitting a Parental Consent Form to us. Please review the Campaign Terms for more information.

Other terms and conditions or collection notices may also apply to you that we will make you aware of, such as competition prize terms and conditions for prize draws that we may run from time to time.

 

What is the One Foot Forward App?

The App enables you to:

  • log and track the distance you (and if relevant, your team) have walked during the Campaign.
  • track the amount of funds you (and if relevant, your team) have raised during the Campaign.
  • set goals for the distance you wish to walk during the Campaign
  • connect the App to other health apps to enable you to sync and improve your activity tracking e.g. Fitbit, Apple Health or Health Connect; and
  • share your progress and achievements to your social media pages and your networks.


What personal information do we collect and how do we collect it?

We will generally collect your information directly from you in connection with this Campaign. However, in some cases we may collect your information indirectly, which occurs when your information is provided to us by your friend, family or colleague who wants to invite you to join the Campaign.

Personal information

How and when do we collect this information?

Personal and contact details

This may include your:

  • full name;
  • date of birth;
  • address;
  • email address;
  • phone number;
  • gender; and
  • photo (if uploaded).

 

We will collect your personal information:

  • via our website when you register to be a participant of the Campaign;  
  • via our website when you do not complete your registration. We will use this to contact you about your incomplete registration and to send you information about our upcoming BDI events and news. You can opt-out of this at any time (see direct marketing section below);
  • when you use the App; and
  • if you choose to make a personal donation to the Campaign.

 

We may also collect your personal information indirectly if you have been invited to join the Campaign by a friend, family member or colleague.

 

If you are inviting someone to participate in the Campaign and you provide BDI with contact details of another person, you must ensure you have their permission to provide us their personal information and that they are happy to be invited to the Campaign.

Location data

This may include:

  • data that you provide to us manually via the App or website (i.e. the kilometres you walked); and/or
  • data that you enable the App to track and record automatically (i.e. the distance you walked that day). 

We collect and process your location data when you register for the Campaign and when you sign up for and use the App (either individually or as part of a team). We collect location data to record and track your fitness activity during the Campaign. If you want the App to automatically track your device location so that it can log your distance walked during the Campaign, you must enable the App to track your device location. If you enable automated location tracking, the App will track this data while the App is open. 

 

If you enable automatic tracking, we will collect your starting latitude and longitude (start lat-long) and the ending latitude and longitude (end lat-long), as well as the total distance travelled and the duration of your activity to calculate the total distance and time travelled.

 

How to disable automated location tracking

 

If you do not wish to turn on automated location tracking in the App, you can still manually record your distance via our website or through our App.

Importantly, you can turn off device location tracking at any time by going to the Settings section of your phone and turning this off with respect to the App.

Health information

This may include your Fitbit, Garmin or other health app data.

If you enable location tracking or manually input your information into the App or website, we will collect health information, such as your fitness information, including distance, speed, exercise, steps.

 

Third party apps

 

If you choose to link and connect the App to other apps to improve your activity tracking, such as Fitbit or Garmin, we will collect this information held in the relevant applications (as relevant).

 

If you choose to link the above services with the App, please note that the handling of your personal information by these third parties will be handled in accordance with their respective privacy policies, including:

Importantly, you can unlink these services by going to the relevant service in your phone (e.g. Fitbit application) and turning the relevant service off with respect to the App.

 

In-built Health apps

 

For Android users, when you use our App, you will be asked if you want to link the App to the Android ‘Health Connect’ app. If you link your App to the Health Connect app, we will be able to access and share certain data, such as the distance, duration and number of steps you have taken, from the past 30 days. You can revoke this permission at any time via the App.

 

For Apple users, when you use our App you will be asked if you want to link the App with the Apple ‘Health App’ to allow the App and the Health App to sync your steps, distance and workout data. You can revoke this permission at any time via the App.

 

The data across ‘Health Connect’ and the Apple ‘Health App’ allows for live activity tracking and provides users with calculations of total distance, time taken, starting latitude and ending longitude coordinates.

 

Deleting health and fitness data: You can delete your health and fitness information (which includes your location data) from the App by editing your fitness log and choosing to delete your entry.  If you delete this information from the App, this data will also be deleted from your Account.

Blog content

This may include:

  • information you submit and share to your fundraising page in the App or website (including any photos or other content you attach or otherwise submit through the App or website).

If you make any blog posts on our website or in the App, we will collect this information. Your blog posts will be publicly available to visitors to our website.

Online and digital services information

This may include information collected from you electronically, which includes information such as your IP address and details about your device.

When you use our website or the App, we may collect information from you electronically (through online technologies). In some cases, this may be personal information and other times we cannot identify you.

 

Why do we collect, store and use your personal information?

We will collect and use your personal information for the purpose of facilitating the provision of services to you through our website or the App.

This includes:

  • to register you for the Campaign and to assist you to manage your fundraising profile and activities;
  • to process and manage your donation if you make a personal donation to the Campaign;
  • to process and manage your participation in a prize draw which you may be eligible for from time to time (including to contact you if you have won a prize);
  • to assist you in tracking and logging the distance you have travelled during the Campaign;
  • to connect any other health services, you may wish to link (e.g. Fitbit, Health Connect, the Apple Health App), in order to track your activity for the purposes of the Campaign; and
  • to publish any blog posts you make to your fundraising page.

We will not use any health or fitness information that you may record or otherwise sync to your Account (either automatically via activity tracking or manually) for any purpose other than providing our services to you via the App or website.

How is your personal information used for marketing purposes?

We may use and disclose your personal information for marketing purposes, including to promote the Campaign and any future campaigns and the services and work the Black Dog Institute provides, including letting you know how your donation has been used.

You consent to us (or agents acting on its behalf) communicating with you via email, SMS, push notifications or social media, to promote this and any future Black Dog Institute campaigns and our mental health, research and other services. If you stop participating in the Campaign or otherwise request us to delete your Account, we may still send you marketing communications relating to BDI’s upcoming events and news unless you have opted-out of those communications.

This means we may share your personal information with our agents so that they can send you marketing communications on our behalf.

Important points regarding opting out

You are always in control of the direct marketing communications which you receive and can opt-out at any time. Generally, you can opt-out by following the relevant opt-out or unsubscribe instructions in the relevant communication (such as email or SMS message). In addition, you can control the types of communications you would like to receive through the “Settings” function in the App or in your device settings (for example, disabling push notifications).  

You can also contact us using the details set out below to tell us you would like to stop receiving direct marketing communications from us.

Importantly, regardless of whether you opt out from receiving any or all direct marketing communications, we will still communicate with you if we are required by law to provide you with information, or in relation to the services we are providing you with or to let you know if you have won a prize in a prize draw.

Who will we share your personal information with?

We may share your personal information with:

  • our app developers, including Funraisin;
  • any social media network platforms or your social networks, if you decide to share this information via the App (including via the QR code functionality);
  • our third party service providers and advisors (such as our IT service providers, third party storage providers, marketing and communication agencies and professional advisors and consultants)
  • any law enforcement agencies or regulators, or as otherwise required under law.

In the App, you can also share your activities with your contacts via text, email, or on social media applications like Meta, Instagram, and X, to update your networks on your progress during the Campaign or to raise funds. If you share your activities on social media platforms, they will be viewable on such third-party platforms, including your location information. You should use caution when sharing information via third parties and you should carefully review the privacy practices of such third parties.

We will not share any health or fitness information that you may record or otherwise sync to your Account (either automatically via activity tracking or manually) with any third parties without your consent. This means we will not use this information for any purpose other than providing our services to you via the App or website.

Third Party Business via API or Other Integrations

We enable you to share your information and content with third party apps and devices that integrate with the App (e.g. Fitbit, Apple and Google), as well as with third parties who work with BDI to offer an integrated feature, such as a GPS tracking. You can choose to share your profile data and activity data with these third parties. Information collected by these third parties is subject to their terms and policies and may not provide you with the same privacy controls that are available on this App. BDI is not responsible for the terms or policies of third parties.

Will your personal information be transferred overseas?

Your personal information collected in connection with this Campaign will generally be stored in Australia. We may also from time-to-time also share this information with our third party service providers who provide products and services to us (including in connection with the App) and otherwise in accordance with our Privacy Policy. These third parties may be located (and therefore your personal information may be disclosed) overseas, including the USA and other countries from time to time.

What happens if you do not want to provide your personal information?

If you do not provide your personal information, we may not be able to:

  • register you to participate in the Campaign;
  • process any personal donations that you have made to the Campaign;
  • enter you into our prize draws that we may offer from time to time; and/or
  • provide you with the App (or certain services or functionalities within the App, such as the ability to track the distance walked during the Campaign) However, you are still able to log your distance manually via our website or through the App.
